SOUTH BEND — The case of a 24-year-old man accused of raping a 67-year-old woman is now heading to trial. Anthony Frick is charged with six counts in the October incident, including rape, impersonating a public servant and two counts of criminal deviant conduct as Class A felonies. Frick previously had accepted a plea agreement but under questioning Thursday, he disputed an allegation that he threatened his victim’s life. According to Indiana sex offense law, in order for criminal deviant conduct to be treated as a Class A felony, the offense must have been committed by "using or threatening the use of deadly force," or "committed while armed with a deadly weapon." Friday in court, Frick continued to insist that he never told his victim he would kill her during the attack. Since Frick could not provide a factual basis for all charges against him, St. Joseph Superior Court Judge Jane Woodward Miller said she could not accept the plea agreement.
